1. What is THC-A?
THC-A (Tetrahydrocannabinolic Acid) is a non-psychoactive cannabinoid found in raw and live cannabis. It is the precursor to THC (Tetrahydrocannabinol), the compound responsible for the “high” feeling. THC-A becomes THC when exposed to heat through a process called decarboxylation. In its natural form, THC-A offers a variety of therapeutic benefits without the intoxicating effects of THC.
2. The Legality of THC-A
THC-A is federally legal in many places as it is non-psychoactive. However, it can vary based on state laws:
- Federal Status: THC-A derived from hemp (containing less than 0.3% THC) is legal under the 2018 Farm Bill. However, once heated or decarboxylated, it converts to THC, which can create legal gray areas depending on state laws.
- Can THCa hemp flower be shipped across state lines? Yes, the interstate transport of hemp, including THCa hemp flower, is permitted by federal law. Under 7 USC § 1621, states and Indian tribes cannot prohibit the transportation of hemp or hemp products through their territories, as long as the hemp was produced according to federal standards outlined in the Agricultural Marketing Act of 1946. However, state laws regarding the sale and possession of THCa hemp flower still apply.
